India Tightens Foreign Visitors' 180-Day Stay Requirements and Makes Visa Extensions More Difficult

India Tightens Foreign Visitors' 180-Day Stay Requirements and Makes Visa Extensions More Difficult

Stricter immigration regulations have been implemented in India for foreign nationals who intend to stay for a long time. Visa extensions will only be given in extraordinary situations, and visitors must now register before the 180-day restriction is reached. The action is intended to increase surveillance of long-term foreign residents and enhance compliance.

Stricter immigration regulations will now apply to foreign nationals who intend to stay in India for an extended period of time. The additional time that was formerly granted after exceeding the 180-day stay limit has been eliminated by the Ministry of Home Affairs' (MoHA) revised registration procedures.

The most significant modification is straightforward: sign up prior to the end of your authorized stay rather than after

The New 180-Day Visa Stay Rule in India

In the previous system, after spending 180 days in India, certain foreign nationals could register with immigration authorities within 14 days.

The grace period is ended. Visitors with 180-day or shorter visas who want to stay longer must now finish their registration before the end of the allotted 180 days
Travelers with longer-validity visas that restrict each stay to 180 days are also subject to the updated regulations. Before staying for more than 180 days in a row or exceeding the allotted cumulative stay limit in a calendar year, these guests must register.

Visa Extensions Are No Longer a Standard Procedure
Additionally, the government is becoming more stringent when it comes to petitions for visa extensions. The revised framework states that authorization to stay in India for longer than the customary 180 days will only be given in dire situations rather than as a regular administrative sanction.

This actually represents a larger trend toward more stringent immigration oversight, moving India closer to the compliance-first strategy currently observed in a number of popular tourist destinations.

Relief for Families of Different Nationalities
Long-term foreign residents are subject to stricter regulations, however there is one relaxation.
Families in which one parent is an Indian citizen and the other is a foreign national no longer have to deal with an administrative hardship. In the past, in order to obtain a visa and an exit permit, a child's birth in India had to be electronically registered within 30 days.

What Visitors from Other Countries Should Do
The Foreigners Regional Registration Office's e-FRRO system is being used by authorities to advise eligible travelers to finish their registration well in advance of the 180-day deadline.
If you don't comply, you might:
Fines and penalties
Obtaining visa extensions is difficult.
Issues with immigration compliance
Proceedings for expulsion in severe circumstances

Effects on Foreigners in India
Expatriates, students, researchers, foreign spouses, business travelers, and other long-term visitors to India are all affected by the new regulations.

Before exceeding the 180-day stay limit, foreign nationals must now finish the registration process. Penalties, problems extending the visa, or other immigration concerns could result from missing the deadline.

Rather than a travel limitation, we view this as a compliance-focused change. It is still possible for legitimate visitors to register earlier, but they can no longer wait until the last minute.
